1. Object.

These General Conditions regulate the online purchases formalised via leticiavalera.com website (hereinafter, the “Website”), these being a purchase contract (hereinafter, the “Contract”) when you click “accept” at the end of the Purchasing Process. Therefore, you are bound to comply with what it is stipulated in these General Conditions.

LETICIA VALERA S.L., with registered office in Pintor Benlliure 30, 46111, Rocafort, Valencia (Spain) (address not applicable for returns) and CIF number B-98677925 (hereinafter, “leticiavalera.com”), is registered in the Mercantile Register of Valencia, Volume 9863, Book 7145, Sheet 14, Page V- 161877. leticiavalera.com may modify these General Purchase Conditions at any time. These modifications will by no means affect the purchases that had been placed prior to the approval of these modifications. They will in any case be governed by the then-current General Conditions that were applicable during the purchase process. It is the responsibility of the customer to be aware of the General Conditions in force at the start of the Purchase Process.

These General Conditions can be filled out or edited with specific clauses or conditions for certain products, especially regarding the exclusion of withdrawal rights, changes or returns that are based on the characteristics of products. Please read the product's information carefully to be informed of these specific conditions.

An electronic document where the Contract is formalised will be filed by leticiavalera.com and available to be accessed through our website, only with prior authentication of the user, password or all media established for the purpose. You may request a paper copy at info@leticiavalera.com

Unsubscribing as a user will lead to the cancellation of your personal user data and makes future online purchases impossible unless you register again as a user.

4. Bid coverage and purchase particularities.

Online sales via leticiavalera.com are not geographically limited. However, for purchases with a delivery address to Spain, the shipping costs will be 3,50€; to Europe and Greenland, an additional amount of 6€ will be added to the PVP on shipping expenses.

As for the Rest of countries not included above (The Rest of the World), consumers must pay an amount of 9 € plus PVP for shipping expenses.

5. Quality of electronic contract services.

leticiavalera.com ensures that all the products commercialised through the Website have the maximum quality and optimum features.

leticiavalera.com has made its best efforts to achieve that the presentation of the product images on the Website is as close as possible to reality. Nevertheless, some product characteristics such as colour or texture could be perceived diffusely or look different in the images, depending on the conditions of the device displaying them.

Products published on leticiavalera.com are accompanied by the following information:

Despite the above, some details may vary based on the offered product and its specific characteristics.

6. Validity of offers

Without prejudice to that stipulated in the corresponding legislation, offers or products sold online will be valid during the period established by leticiavalera.com or, at least, during the time that recipients can have access to them.

7. Product availability.

If we find that any of the products included in the order are not in stock when the order is issued, we will contact you to inform you of the impossibility of supplying that item, and we will proceed to pay the corresponding amount. The above shall not limit your legal rights as a consumer.

8. Purchase process.

The Purchase Process is divided into the following steps:

●      From the available options, choose which one you wish to include (E.G. in the case that you wish to purchase a bag, you must select one of the available options: fabric, handles, fastener.) Where some characteristics cannot be adjusted, choose solely the amount of units you would like to purchase.

●      Beginning of the purchase process: To begin the purchase process, please click on the “Buy” button.

●      If you are not registered as a User or have not accessed the site as such, you will be asked to do so before proceeding.

●      Verification of purchase details: Before selecting a payment method, you may check your purchase details and correct any errors which may have occurred when entering the data. Once your information is verified, please confirm your order.

●      When a product is added, you can continue shopping or delete the item. The shopping cart contains the name of the selected product, reference, colour, size, quantity and price in Euros.

●      Select your Payment method: Choose your favourite payment method and click on the Pay button. Then, you will be redirected to the system of the payment method chosen, where you will need to provide all the necessary information to confirm your payment. This is the only time that you will be asked to provide this information.

●      Once all necessary data have been provided and when you click on the button to confirm the purchase, the contract will be in effect for all purposes.

●      Confirm your purchase: Once we receive your acceptance, leticiavalera.com will issue a confirmation on screen which you can archive and which contains the following information:

○      Order number.

○      Order date.

○      Summary of the products included in the purchase.

In any case, leticiavalera.com will issue a confirmation of the purchase by email within the next 24 hours.

During the entire purchase process, you can consult these General Terms and Conditions of Purchase as well as find out the final price of the selected products.

Once the purchase has been confirmed, the customer may not modify or cancel the order except in thoses cases provided for by law or in these General Terms and Conditions.

9. Purchase limitations and prohibition on resale or distribution

This distribution channel is restricted to consumers or final recipients of the products, and any professional resale or distribution activity of the purchased products is therefore prohibited. To this end, leticiavalera.com will not accept purchases exceeding the following limits:

●      Maximum number of units: 20

10. Price

All the prices indicated in our website are in Euros and include VAT. If tariffs were applicable in the destination country, note that these should be paid by the consumer.

All shipping costs will be displayed at the checkout, once the shipping address has been added. The shipping costs will depend on the delivery area (Peninsular Spain and Balearic Islands, the Canary Islands, Ceuta and Melilla; Europe and Greenland or the Rest of the world). The total shipping expense will be displayed during the payment phase of the Ordering process, even though they have already been indicated here. Eventually, leticiavalera.com may put into place promotions based on the use of specific payment methods or of any type. In this case, deliveries will be offered without an additional expense to the consumer. Benefiting from this will depend on the compliance with the corresponding promotion terms.

Before the “make payment” phase, you can find out about the complete and final price of your order, and access the amount of applied increases or discounts, broken down, as well as the transportation costs and other additional services.

Despite the measures leticiavalera.com takes to prevent errors, it may happen that the price of a product applied during the purchase is not the offered price or that the offered price shown on the Website is incorrect. In case such errors were found after the Contract has been formalised, this Contract will be null and void according to the applicable legislation and without limiting your rights as a consumer. leticiavalera.com will notify you about said incident as soon as it finds out about it, and if any amounts have been charged for the purchase, they will be refunded immediately.

11. Payment methods

You can pay the price of the purchased products by any of the following means:

The payment of your order is received in real-time through Virtual POS once the provided data are validated. leticiavalera.com guarantees completely safe and confidential processing of the data relating to your payment method. Your credit card details are transmitted in encrypted format (SSL). This solution guarantees the secrecy of the communication through a dialogue with encryption keys. In order to detect and avoid fraudulent operations and unnecessary harm and inconvenience to our clients, Leticia Valera has adopted fraud prevention measures and controls. These controls consist of the analysis of the characteristics of the orders and their comparison with previous fraudulent operations. Occasionally, in order to ensure that it is not a fraudulent operation, Leticia Valera may require you to complete specific information or to provide other additional information. A refusal to supply said information will prevent Leticia Valera from performing the necessary checks on the authenticity of the order. Under the above scenario, Leticia Valera will be entitled to cancel or reverse the order on the basis of fraudulent operation. Despite our efforts to improve our fraud detection system, in certain cases, a transaction may be identified as fraudulent when this is not actually the case. If you have been affected by this and your operation has been wrongly denied, please notify us using the contact methods provided in these General Conditions. In this way, we will be able to process your enquiry at the earliest possible time.

Additionally, please note that the providers and issuers of the used payment methods can apply different anti-fraud measures beyond the control of leticiavalera.com, which may result in the rejection of certain types of operations. leticiavalera.com does not have control over and is not responsible for damages which may be caused by the application of policies adopted by the different providers or issuers of the payment methods.

The use of a payment method owned by a third party is forbidden except in those cases where this third party has expressly authorised its use, in which case it is your responsibility to prove this authorisation and you will also assume liability for any damages leticiavalera.com may incur.

12. Receipt

leticiavalera.com will send you a paper purchase receipt with your order. If you wish, you can request for an invoice by contacting our Customer Service department within 30 days following your purchase. Invoices can only be emitted to individuals. If you would like to make a purchase as a legal entity, please send an e-mail to info@leticiavalera.com

To do this, you should introduce your ID card or an equivalent national identity document in the relevant field at the time of the ordering process. Leticia Valera may require that you provide your ID card or an equivalent national identity document for regulatory, operational or security purposes.

13. Delivery

The delivery will be complete as soon as you receive the purchased products, regardless of the collection method used: at the delivery address, through a third party or by collecting them personally. Both by home delivery and by shop collection, the recipient will be required to sign a dispatch note or document proving that the product has been delivered. The signature of a delivery note does not imply conformity and only serves as a proof that the delivery has taken place. Therefore, your contractual rights are not affected and it does not imply your conformity with a product in bad condition. Without prejudice to your contractual and legal rights, and in order to process any incident related to goods transportation, we kindly ask you to notify us within 24 hours about any incident related to the shipment, such as the lack or loss of any of the purchased products, a damaged product, opened goods, etc. Please note that a signed delivery note is required for product delivery and you must make sure that it is possible for a third person to receive the purchase on your behalf. leticiavalera.com does not take responsibility for the reception by a third person on your behalf without due authorisation when this reception has been correctly made at the indicated place of delivery.

Home deliveries will be carried out Monday to Friday from 9 am to 7 pm via MRW or DHL courier services. There are no deliveries on Saturdays or Sundays.

The home delivery entails the passing of risk and, consequently, leticiavalera.com shall not be liable for any deterioration of the products, loss or theft occurred afterwards.

In the case of an impossible deliver, leticiavalera.com shall cancel the Contract on the basis of compliance impossibility and without prejudice to any claims that may be initiated by leticiavalera.com in cases of malice or guilt of the consumer.

leticiavalera.com does not accept post office boxes as a valid delivery address. In the event that a Contract includes a post office box address, the Contract will be declared void and will not bind leticiavalera.com to comply with it, although this event may be notified, undoing the amounts previously charged.

Free shipping in Spain (the Canary Islands and the Balearic Islands included) on all products by Leticia Valera. Delivery within 2-3 working days.

In the rest of Europe, the shipping cost is 10€; in the rest of the world, it is 17€. Deliveries within 3-4 working days.

Please be aware that you may need to pay a fee or customs duty on sales. Returns are eligible for a refund if an authorisation form for returns is submitted within 14 days following the original purchase.

SHIPPING

All orders are sent directly from our warehouse and managed by DHL and MRW.

Online orders are generally delivered between 2-3 working days in Spain and between 3-4 working days in the rest of the world, the process starting from the order confirmation date. In case of a delay, you will be informed of this by e-mail.

Shipments in Spain (the Canary Islands and Balearic Islands included) are free of charge. In the rest of Europe, the shipping cost is 10€; in the rest of the world, it is 17€.

As for some particularly big or bulky items (rigid-format lampshades), an additional shipping cost of 70€ will be charged for each item in international shipments. To process this, we will contact you via e-mail once your order has been confirmed.

Despite the above, whenever compliance with these delivery dates depends on third parties, leticiavalera.com cannot guarantee delivery times that are shorter than 15 days. For the purpose of the provisions of the Revised Text of the General Law for the Defence of Consumers and Users approved by Royal Legislative Decree 1/2007 of 16 November the latter date shall be understood as the delivery date promised by leticiavalera.com.

You may request any information on your order's delivery status by introducing the shipping reference on the Correos website.

14. Returns

leticiavalera.com allows you to return your purchase within a maximum period of 14 days from the delivery date, provided that the products returned are unworn and in its undamaged packaging. All the amounts that had been previously received by leticiavalera.com and had to be refunded to the customer in conformity with the stipulated in this section, will be paid, if possible, by the same payment method used during the purchase. In the event that the method used would not be valid for the refund payment, leticiavalera.com will pay the corresponding amount by bank transfer. Please note that your bank entity may take up to 7 days to process the payment. The conditions included in this provision in relation to refunds will apply without prejudice to the imperative rights of consumers in accordance with current legislation. As a result, when a refund is made within the first 15 days following delivery date, what was established in the article 68 and subsequent articles of the Revised Text of the General Law for the Defence of Consumers and Users approved by Royal Legislative Decree 1/2007 of 16 November shall prevail over what was established in this provision. You must submit the proof of purchase that was sent to you with your order.  If you need a copy of this document, please contact our Customer Service department. For the purposes stipulated in the Revised Text Of The General Law For The Protection Of Consumers And Users approved by Royal Legislative Decree 1/2007 Of 16 November, this document will be deemed as a withdrawal form. leticiavalera.com reserves the right to reject any return submitted out of the established time, or any item that does not preserve its original condition.

Returns by post:

Follow these steps to return your items by post:

1. Contact our Customer Service department to obtain your return code.

2. Fill out the Return Form that we will send to your e-mail address, as requested. Indicate your order number and the reference of each returned item. To obtain this document, please write an e-mail to info@leticiavalera.com. For the purposes stipulated in the Revised Text Of The General Law For The Protection Of Consumers And Users approved by Royal Legislative Decree 1/2007 Of 16 November, this document will be deemed as a withdrawal form.

3. Place the returned items together with the Return Form in a box or envelope and specify the return delivery address, order number and return number on the parcel.

The costume jewellery comes in a see-through seal thanks to which you can check the product condition without removing the seal. For hygiene reasons, we will not accept returns of these products when they are opened and without their original sealed packaging.

leticiavalera.com will reject any return submitted out of the established time, or any item that does not preserve its original condition.

For security reasons, we recommend that you ship your return with a certified mail or a service that includes receipt notification. leticiavalera.com shall not be responsible for the returns that do not reach their destination address.

You must bear the shipping costs of the items you wish to return. leticiavalera.com will not accept returns with unpaid postage. The returned items will be inspected carefully. When the product is returned in its undamaged packaging and with its labels inside, we will proceed to refund the corresponding amount.

15. Force majeure or unforeseeable circumstances

leticiavalera.com shall not be liable for the complete or partial non-performance, improper performance or delay in performing any of your obligations when they were caused by force majeure or unforeseeable circumstances. Under these assumptions, any established agreement or term in force shall be suspended for as long as the force majeure or unforeseeable situation is prolonged, and only resuming agreements and terms once the mentioned circumstance has disappeared.

16. Out-of-court dispute resolution:

Any dispute arising out of the interpretation, application, compliance or execution of this contract, including any dispute relating to its existence, validity or termination, as well as, in general, all matters associated with it, shall be finally settled by arbitration of the law, administered by the Arbitration Tribunal of Valencia (Arbitration Tribunal of the Illustrious bar association of Valencia Ilustre TAV, a foundation of Comunidad Valenciana, with office in Valencia, Plaza de Tetuán, 16) in conformity to its Regulation, which shall be understood as included in this disposition for all intents and purposes. The arbitration shall be decided by a single arbitrator and shall be held at the seat of the Arbitration Tribunal of Valencia.

These General Purchase Conditions and any document they expressly refer to (such as particular provisions or specific conditions for certain products and adequately accepted by you at the time of accepting their purchase) constitute the entire Contract, replacing any other agreements or pacts that the parties may have agreed to verbally or in writing prior to the execution of the Contract.

19. Applicable Law:

The law that shall be applicable to the Contract is Spanish law, without prejudice to the cases in which the application of the laws of other States may be mandatory.
